    INTRODUCTION - GENERAL PROVISIONS

    A.

    Short Title. This publication together with all future amendments shall be known as the "The City of Colorado Springs/El Paso County Drainage Criteria Manual" (hereafter called "Manual") BEING PART OF AND SUBJECT TO THE City of Colorado Springs Subdivision Policy Manual and El Paso County Land Development Code and Subdivision Criteria Manual.

    B.

    Jurisdiction. This manual shall apply to all land within the boundaries of El Paso County, including public lands. This manual shall apply to all facilities constructed on City/County ROW, easements dedicated for public use, and to all privately owned and maintained stormwater facilities.

    C.

    Purpose. Presented in this manual is the minimum design and technical criteria for the analysis and design of storm drainage facilities. All subdivisions, resubdivisions, planned unit development, or any other proposed construction submitted for approval under the provisions of the manual shall include adequate storm drainage system analysis and appropriate drainage system design. Such analysis and design shall meet or exceed the criteria set forth herein. Options to the provisions of this criteria may be suggested by the applicant. The burden of proof that the options are equal or better is the responsibility of the applicant.

    D.

    Amendment and Revisions. The policies and criteria may be amended as new technology is developed or if experience gained in the use of this manual indicates a need for revision. All changes will require the review and recommendation of the City/County. Technical criteria changes will be recommended by the Engineering Department. Any revisions will require adoption by resolution of the Board of County Commissioners and/or City Council following a public hearing thereon. The City/County Engineer shall monitor the performance and effectiveness of the criteria contained in the manual and will recommend amendments and revisions after one year, approximately three years, and as needed.

    E.

    Enforcement Responsibility. It shall be the duty of the Board of County Commissioners acting through the Director of Public Works and the City Council acting through the City Engineer to enforce the provisions of this manual. The Floodplain Administrator also shall enforce those floodplain regulations within his jurisdiction.

    F.

    Review and Approval. The City/County will review all drainage submittals for compliance with the manual. An approval by the City/County does not relieve the owner, engineer, or designer from the responsibility of insuring that the calculations, plans, specifications, construction, and record drawings are in compliance with the manual as stated in the owner's engineer's certification, as required in Chapter 4.6.

    G.

    Interpretation. In the interpretation and application of the provisions of the manual the following shall govern:

    1.

    In its interpretation and application, the provisions shall be regarded as the minimum requirements for the protection of the public health, safety, comfort, morals, convenience, prosperity, and welfare of the residents of the City and County.

    2.

    Whenever a provision of this manual or any provision in any law, ordinance, resolution, rule, or regulation, contain any restrictions covering any of the same subject matter, the law, ordinance, resolution, rule or regulation shall govern.

    3.

    This manual shall not abrogate or annul any permits or approved drainage reports and construction plans issued before the effective date of this manual.

    H.

    Use of Manual. This City of Colorado Springs/El Paso County Drainage Criteria Manual (herein referenced as "manual") has been divided into four sections which contain twelve chapters and an appendix. The manual format is listed on page D. Each manual has been numbered and is recorded with the name and address of the owner. Periodic updates will be mailed to those registered owners of the manual.

    Section I of the manual contains the drainage policies, criteria, finance and administration text. This section should be referred to by City/County administrators and project owners. Chapter 4 in Section I contains the City/County submittal and review procedures and should be read by everyone.

    Section II of the manual contains hydrologic analysis procedures. This will be one of the more heavily used sections of the manual by engineers.

    Section III of the manual contains suggested design methods and minimum standards. Procedures outlined in this section may be directly utilized by the engineer to solve drainage problems. The engineer may also use methods demonstrated to the City/County as equal or superior.

    I.

    Acknowledgment. This manual was prepared by HDR Infrastructure, Inc. under contract with the City of Colorado Springs - Department of Public Works and El Paso County Department of Transportation (Public Works). The preparation of this manual involved a considerable effort from the staff of the City and County as well as participation by members of the Technical Advisory Committee.

    Drainage Criteria Manual Authority. The following resolutions by the City of Colorado Springs and by El Paso County provide the date the Manual becomes effective and their jurisdictional limits.

    Resolution No. 135-87

    A RESOLUTION ADOPTING THE CITY OF COLORADO SPRINGS/EL PASO COUNTY
    DRAINAGE CRITERIA MANUAL AS A PART OF THE
    CITY OF COLORADO SPRINGS SUBDIVISION POLICY MANUAL

    WHEREAS, the City of Colorado Springs' Department of Public Works has jointly with El Paso County Department of Transportation prepared a City/County joint Drainage Criteria Manual; and

    WHEREAS, a joint City/County Drainage Criteria Manual will benefit the entire community; and

    WHEREAS, the manual contains technical engineering procedures and criteria which updates and adds to current engineering criteria; and

    WHEREAS, the City of Colorado Springs will benefit from an improved stormwater management program;

    NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLORADO SPRINGS:

    Section 1. That the City of Colorado Springs/ El Paso County Drainage Criteria Manual become a part of the City of Colorado Springs' Subdivision Policy Manual.

    Section 2. That the City of Colorado Springs/El Paso County Drainage Criteria Manual become effective for use in all subdivisions and construction projects within the public jurisdiction for all plans submitted after October 1, 1987.

    Resolution No. 175-91

    A RESOLUTION ADOPTING CERTAIN AMENDMENTS AND REVISIONS
    TO THE CITY OF COLORADO SPRINGS EL PASO COUNTY DRAINAGE CRITERIA MANUAL

    WHEREAS, The City of Colorado Springs/El Paso County Drainage Criteria Manual (hereinafter called "Manual" was adopted by City Council on September 8, 1987 as part of the Subdivision Policy Manual; and

    WHEREAS, Experience gained in the use of the Manual by both the public and private sector since its adoption indicates the need for certain revisions to the Manual; and

    WHEREAS, The City of Colorado Springs/El Paso County Drainage Board (Drainage Board) at their September 19, 1991 meeting approved certain amendments and revisions to the Manual; and

    WHEREAS, The amendments and revisions approved by the Drainage Board will be a benefit to the City of Colorado Springs by providing for an improved Stormwater Management Program;

    NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLORADO SPRINGS:

    Section 1. That the City of Colorado Springs Subdivision Policy Manual is hereby revised by adopting the amendments and revisions to the City of Colorado Springs/El Paso County Drainage Criteria Manual which were approved by the Drainage Board on September 19, 1991.

    Section 2. That the revised Subdivision Policy Manual become effective for use in all subdivisions and construction projects in the City of Colorado Springs on November 1, 1991.

    Commissioner Meier moved adoption of the following Resolution:

    BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE
    COUNTY OF EL PASO, STATE OF COLORADO

    RESOLUTION NO. 87-178A, Land Use-67A

    WHEREAS, the El Paso County Department of Transportation requests approval of the City of Colorado Springs/El Paso County Drainage Criteria Manual which sets forth provisions for drainage policies, criteria, finance and administration as herein described; and

    WHEREAS, a public hearing was held by the El Paso County Planning Commission on April 21, 1987, upon which date the Planning Commission did by formal resolution recommend approval of the subject Manual; and

    WHEREAS, a public hearing was held by this Board on June 22, 1987; and

    WHEREAS, based on the evidence, testimony, exhibits, recommendations of the El Paso County Planning Commission, comments of the El Paso County Land Use Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:

    1. ;hg;That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of El Paso County.

    2. ;hg;That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at those hearings.

    3. ;hg;That all data, surveys, analyses, and studies, as are required by the State of Colorado and El Paso County have been submitted, reviewed, and found to meet the intent of the General Provisions of the El Paso County Subdivision Regulations.

    4. ;hg;That the proposal shall hereby amend the Subdivision Criteria Manual for El Paso County by deleting present Section DC (Drainage Criteria) in its entirety and incorporating by reference the Drainage Criteria Manual.

    5. ;hg;That for the above-stated and other reasons, the proposed Manual is in the best interest of the health, safety, morals, convenience, order, prosperity, and welfare of the citizens of El Paso County.

    NOW, THEREFORE, BE IT RESOLVED that the following City of Colorado Springs/El Paso County Drainage Criteria Manual, as more particularly described in Exhibit A, as recorded at Book 5561, Page 10, of the El Paso County Clerk and Recorder records be approved;

    BE IT FURTHER RESOLVED that the record and recommendations of the El Paso County Planning Commission be adopted.

    WHEREAS, the El Paso County Department of Public Works requests approval of Amendments to the City/County Drainage Criteria Manual as herein described by the addition of clarifications to criteria without changing intent, correction of numerous typographical errors and modification of criteria; and

    WHEREAS, a public hearing was held by the El Paso County Planning Commission on August 20, 1991, upon which date the Planning Commission did by formal resolution recommend approval of the subject Amendments; and

    WHEREAS, a public hearing was held by this Board on October 10, 1991; and

    WHEREAS, based on the evidence, testimony, exhibits, recommendations of the El Paso County Planning Commission, comments of the El Paso County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows:

    1. ;hg;That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners of El Paso County.

    2. ;hg;That the hearings before the Planning Commission and the Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at those hearings.

    NOW, THEREFORE, BE IT RESOLVED that the Amendments to the City/County Drainage Criteria Manual more particularly described in the attached Exhibit A, including any typographical corrections, be and are hereby approved;

    BE IT FURTHER RESOLVED the City/County Drainage Criteria Manual shall be further modified to reflect the required hydrologic analyses will not include the utilization of Antecedent Moisture Condition 3 and instead utilizing only Antecedent Moisture Condition 2;

    AND BE IT FURTHER RESOLVED the City/County Drainage Criteria Manual attached hereto supersedes the Manual previously amended by the Board on February 11, 1988;

    AND BE IT FURTHER RESOLVED that the Amendments shall be effective as of this date;

    AND BE IT FURTHER RESOLVED that the record and recommendations of the El Paso County Planning Commission be adopted.
